An accused bike-riding burglar is fighting for his life after he was shot by a man protecting his pregnant wife and young child.
The shooting happened Monday night at a home on Arrid Pass on the Northwest Side.
Brian Stevens told News 4 his wife, whose six months pregnant, had just called him after she noticed someone lurking around the house. When Stevens got home, he saw the suspect going house to house. He went inside his home and then heard some rattling coming from his own back fence. Stevens then ran upstairs and grabbed his gun.
"I was waiting for the police, and he just walked in the door. He just walked in," explained Stevens.
Stevens said a man later identified as Stephen Garcia made his way inside the home and started walking towards him.
"I gave him plenty of times. I mean, I was screaming at him, telling him 'Get out of my house. Who do you think you are? Just get out. Get out!'," Stevens told News 4.
But Stevens said the 21-year-old intruder kept coming.
"He started to pick up the pace and walk a little bit faster," said Stevens. "And that's when I, um, pulled the trigger, and a shot did not go off."
The safety was on. So, Stevens kept backing up.
"I just knew that something ain't right," Stevens added. "That I don't want to get into a fight with this guy. We're in the kitchen, there's knives and stuff in there."
So, Stevens fired another round.
"I lowered the gun and just shot him one time, and he fell real quick," said Stevens.
Police said Stevens will not face any charges for pulling the trigger.
Stevens told News 4 he just wants the intruder to be okay.
Garcia remained in critical condition at University Hospital as of Tuesday afternoon. Police found a beer can in his pocket and suspect he was drunk when he entered the home.
