AURORA | A fifth-grader at Aurora Frontier K-8 says he's been suspended from school for wearing a homemade T-shirt that said "Obama is a terrorist's best friend."
Eleven-year-old Daxx Dalton and his father, Dann Dalton, say his First Amendment rights were violated.
Aurora Public Schools officials say they respect students' free speech rights but also watch for things that might interrupt the learning environment.
In a statement, school officials said Dalton got into an altercation on the playground because of the shirt, and that the ruckus made its way into the classroom. It was then school administers intervened and asked the boy to either turn the shirt inside out, change it or go home with a suspension.
The boy chose suspension, officials said.
Georgia Duran, spokeswoman for the district, confirmed it wasn't the message on the t-shirt that garnered the suspension.
"We are not able to comment on an individual student's disciplinary issue," district officials said in a release. "We thoughtfully and consistently enact student discipline when needed. Aurora Public Schools respects a student's right to free speech, such as the right to wear specific clothing. In fairness to all students, we would review a situation that is distracting or that interrupts the environment where students are learning."
Not speaking specifically to this case, she said students can be suspended for refusing to follow teacher or principal instructions - such as refusing to turn their shirt inside out if asked.
Duran said that a dean or the principal made the call that the shirt was disrupting the learning environment.
Dann Dalton, a self-described conservative, told Fox 31 News he's considering a lawsuit.
School officials plan to hold a press conference at 2:30 p.m. to address the issue.
